Civil Rights/Title IX: Prohibiting Sex-Based Discrimination
In accordance with Federal Civil Rights Law, Cayucos Elementary School District is prohibited from discriminating based on gender, gender identity or expression, or genetic information, race, color, religion, ancestry, nationality, national origin, immigration status, ethnicity, ethnic group identification, age, sex, marital status, pregnancy, parental status, physical or mental disability, sexual orientation; the perception of one or more of such characteristics, or association with a person or group with one or more of these actual or perceived characteristics.
Title IX of the Education Amendments of 1972 (“Title IX”) is a federal law that prohibits sex-based discrimination in all educational programs and activities, including athletic programs. No person shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any educational program or activity operated by Cayucos Elementary School District. Title IX protects all participants in Cayucos Elementary School District's educational programs and activities, including students, parents, employees, and job applicants. Cayucos Elementary School District does not discriminate on the basis of sex. Discrimination on the basis of sex can include sexual harassment and sexual violence.
Cayucos Elementary School District and the Title IX Coordinator are aware of and acknowledge the new Title IX regulations released on May 6, 2020 and effective as of August 14, 2020. Our Title IX team received training on these new regulations on August 14, 2020, and have made our Title IX training available online for review . How To File a Title IX Complaint:
Individuals may file a complaint as follows - The complaint should be presented to the Title IX coordinator. All complaints should be filed in writing and signed by the complainant. If a complainant is unable to put a complaint in writing due to conditions such as a disability or illiteracy, district staff shall assist the individual in the filing of the complaint. In order to file a complaint with the District, individuals must file the complaint within 6 (six) months of the discrimination occurring or awareness of the discrimination. BOARD POLICIES
In addition to Title IX, the California Education Code prohibits discrimination on the basis of sex in schools. (California Education Code §§ 220-221.1.) Other state and federal laws also prohibit discrimination and ensure equality in education. Administers a fair investigation of formal complaints.
Title IX Decision-Maker: Elizabeth Villalobos (Principal)
Reviews the investigation report, makes a determination about responsibility, and makes determination about responsibility.
Informal Resolution Officer: Elizabeth Villalobos (Principal)
Facilitates the informal resolution process and ensures the parties know their rights.
Appeals Officer: Jen Gaviola or appointed officer (Superintendent)
Evaluates any appeal request and makes a decisions on the appeal.
